1. Description of Promotion

Eligible participants (as further described in Section 6) have the chance to win concert tickets for (2) people (the “Promotion”). Place a Qualifying Bet (as defined below) during the period between 12:01am (EST) on September 29, 2023 and 11:59pm (EST) on October 4, 2023 (the “Promotional Period”) and the Qualifying Bet that has the longest odds and wins will win the Prize (as defined below) (subject to the terms and conditions set forth herein). For greater certainty, a successful $5.00 parlay with +1030 odds (payout $56.50) will beat a successful $10.00 parlay with +492 odds (payout $59.20). Additional details on the Prize are provided in Section 5. 

A “Qualifying Bet” means a bet that meets all of the following criteria: 

• Any bet on the PointsBet Canada sportsbook during the Promotional Period;  

• A bet that is made in cash (no Bonus Bets) and be equal to $5.00 or more; and 

• A bet that settles before 11:59pm (EST) on October 4, 2023.

PointsBet Canada will inform participants of the current odds wining the Promotion during the Promotional Period on the homepage of the PointsBet Canada website once a user is signed in. The winner of the Promotion will be announced on October 5, 2023 and will be notified via the contact information provided in the player’s Account (as defined below). In the case of multiple Qualifying Bets with the same longest odds and winning outcome, the Qualifying Bet that was submitted and received by PointsBet Canada first, as determined by PointsBet Canada, will win.

4. How to Participate

There is no purchase necessary to enter or win this Promotion. During the Promotional Period, users can participate in the Promotion using the following methods:

1. Wager: Visit on.pointsbet.ca or the PointsBet Canada mobile application (collectively, the “Website”), log in to your Account and place a Qualifying Bet.

2. Alternative Method of Entry (Mail-In Entry): Participants may mail the below information to the PointsBet Canada at 315 Queen Street West, Toronto, Ontario, Canada, M5V 2A4 Attn: Legal Department. To be eligible, all of the information in the mandatory template below must be included and legible on a 7” x 11” paper. If the participant is participating in this Promotion through the Alternative Method of Entry, the participant is not required to place the Qualifying Bet on the Website but rather may submit a printed screenshot of the Qualifying Bet with no wager required. To be eligible, mail-in submissions must be postmarked no later than the start of any individual bet that is part of the Qualifying Bet. All mail-in submissions must be received by PointsBet Canada no later than October 3, 2023. Participants may only submit one (1) Alternative Method of Entry throughout the Promotional Period. Any additional Alternative Method of Entry submissions made will be voided.

Submissions that are in excess of the stated limits, incomplete, illegible, corrupted, damaged, destroyed, forged, false, lost, late or misdirected, deceptive, or otherwise not in compliance with these terms and conditions may be disqualified from the Promotion at PointsBet Canada’s sole and absolute discretion. Submissions made by entrants who do not meet the eligibility requirements (including, but not limited to, all requirements with respect to age and residence) are void. Each participant must be the rightful owner of the email address and/or the Account used. All materials submitted by participants become the property of PointsBet Canada and, unless otherwise indicated herein, will not be returned. An entry on the Website is “received” when PointsBet Canada’s Website’s servers record the Qualifying Bet information, and a mail-in entry (if applicable) is “received” when such entry is physically received by PointsBet Canada at the address provided herein. Proof of sending does not constitute proof of actual receipt of an entry for purposes of this Promotion. Those who do not follow all of the instructions, provide the required information in the template form above, or otherwise abide by these terms and conditions or other instructions provided by PointsBet Canada may be disqualified at PointsBet Canada’s sole and absolute discretion.

5. Prize

There is one (1) prize (“Prize”) available to be won pursuant to the Promotion, which consists of the following: 

• Two (2) tickets to the Drake concert scheduled for October 6, 2023 at Scotiabank Arena in Toronto, Ontario, Canada. 

All incidental costs and expenses associated with the Prize that are not specifically referred to in this section, including, without limitation, transportation , meals, beverages, gratuities, souvenirs, incidental and personal expenses, and items of a personal nature are not included and are the sole responsibility of the Prize winner.  

The approximate retail value of the Prize is one thousand two hundred Canadian dollars ($1,200). A Prize winner is not entitled to any difference between the actual value of the Prize and the approximate retail value of the Prize as stated herein. Each winner must follow all directions of PointsBet Canada with respect to the Prize or any aspect thereof. Failure to do so may result in termination of participation, or continued participation, in the Promotion, Prize or any aspect thereof.

6. Eligibility

The Promotion is available to all players with an established and verified PointsBet Canada account (“Account”). Players must be 19 years of age or older and be physically present in the province of Ontario during the Promotional Period to qualify and participate in the Promotion.

Individuals on any involuntary province gambling exclusion list, province gambling self-exclusion list, and/or self-exclusion list for PointsBet Canada or any of its subsidiaries are ineligible to participate in the Promotion. 7. Action Required

No opt-in required. In order to participate in the Promotion, eligible participants may participate by either making a Wager or Alternative Method of Entry submission pursuant to the procedures set forth in Section 4.

8. Claiming your Prize

Upon successful contact via email and/or phone on October 5, 2023, the winner will be required to provide certain contact information as requested by PointsBet Canada and confirm compliance with the terms and conditions set forth herein. The winner and guest, if applicable, will also be required to sign a declaration, release and waiver form (the “Release Form”) confirming acceptance of the Prize awarded, without substitution, and releasing  PointsBet Canada and each of their respective parent companies, subsidiaries, affiliates, directors, officers, governors, agents, their advertising and promotional agencies (altogether, the “Released Parties”) from any liability in connection with the Promotion and Prize before being granted the Prize. If PointsBet Canada determines, in its sole and absolute discretion, that the winner does not meet all of the requirements, fails to provide the contact information requested, does not sign and return the Release Form within the time frame specified, or is otherwise unable to be contacted within 24 hours of the first point of contact (or attempt) through the contact information provided in the winner’s Account information, PointsBet Canada shall be entitled to select another winner based on the next highest odds. This process may continue until the Prize has been awarded. In the event that an alternative winner is required to be selected, the same above-noted process will apply. PointsBet Canada reserves the right not to award the Prize after multiple efforts to select an alternative winner. PointsBet Canada is not responsible, whether as a result of human error or otherwise, for any failure to contact any winner or failure to receive a submission.  

The winner of the Promotion must be at least nineteen (19) years of age and older. The winner is prohibited from transferring the Prize to any other party.  

9. Eligible Games

Any sports game on the PointsBet Canada sportsbook that settles during the Promotional Period.

10. Registration Procedures

To qualify for the Promotion, eligible individuals must successfully establish an Account at https://on.pointsbet.ca/signup and have the Account verified. By creating an Account, participants must agree to PointsBet Canada’s Terms & Conditions and Privacy Policy. If you do not agree to PointsBet Canada’s Terms & Conditions and Privacy Policy, you cannot create an Account or participate in this Promotion.

11. Order of Funds Used for Wagering

The default when placing a bet is to place it with cash. To wager using a Bonus Bet (rather than with cash), select “Bonus Bet” in the game. For greater certainty, only cash wagers qualify for this Promotion and bets made with Bonus Bets will not constitute a “Qualifying Bet”, except in the case where a submission is made through the Alternative Method of Entry (as described in Section 4), in which case a cash wager is not required.

12. Cancellation

To cancel participation in this or any promotion, contact customer support by email at customercare@pointsbet.com with your cancellation request. Upon request for cancellation, PointsBet Canada shall inform the player of the amount of unrestricted funds that will be returned upon cancellation and the value of restricted funds that will be removed from the player's Account. If the player elects to proceed with cancellation, unrestricted funds remaining in a player’s Account shall be returned.

13. Promotion Administration

All decisions regarding the Promotion remain with PointsBet Canada. PointsBet Canada reserves the right, at its sole and absolute discretion, to: (i) exclude wagers from any promotional offers without prior notification; (ii) change or cancel the Promotion at any time without prior notification; (iii) exclude or limit any individual(s) from participating in the Promotion for any reason, in its sole discretion, including but not limited to, based on your wagering patterns or wagering history or if it determines there are any irregularities or abuses occurring in connection with the Promotion; or (iv) to otherwise modify, cancel, suspend and/or terminate any or all parts of the Promotion for any reason whatsoever. PointsBet Canada has complete discretion over interpretation of these terms and conditions, of administration and operation of the Promotion and of selection of the winner. Decisions of PointsBet Canada as to the selection of the winner will be final and binding in all matters related to this Promotion. Each selected potential winner and guest may, in PointsBet Canada’s sole and absolute discretion, be required to show a valid issued driver’s license, government issued identification or other identification (subject to PointsBet Canada’s approval) as evidence of identity and/or residency. By accepting the Prize, the winner agrees to allow the Released Parties and their respective subsidiaries and affiliates, promotional and advertising agencies and representatives the right to use his/her name, biographical information, image, photos and/or likeness and statements for programming, promotion, trade, commercial, advertising and publicity purposes in connection with this Promotion, at any time or times, in all media now known or hereafter discovered, worldwide, including but not limited to on television, video, the World Wide Web and Internet, without notice, review or approval and without additional compensation, except where prohibited by law.

15. Indemnification

By participating in this Promotion, each participant, their representatives, heirs, next of kin or assignees (“Participant’s Representatives”), hereby releases and holds the Released Parties harmless from any and all claims, demands, orders, judgments or demands whatsoever, including, without limitation, claims or demands in respect of copyright, trademark or other intellectual property infringement; liability for any injuries, loss or damage of any kind to the participant, Participant’s Representatives or any other person, including personal injury, death or property damage, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any Prize, participation in the Promotion, any breach of PointsBet Canada’s Terms and Conditions or in any Prize-related activity. The participant and Participant’s Representatives agree to fully indemnify the Released Parties from any and all claims by third parties relating to the Promotion, without limitation.

16. Limitation of Liability

None of the Released Parties assume any liability for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Promotion or by any technical or human error which may occur in the processing of participant’s Qualifying Bet’s for the Promotion or for any printing or other errors in any Promotion materials. The Released Parties assume no responsibility for any error, omission, tampering, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or authorized access to, or alteration of assessment of the Qualifying Bets. The Released Parties are not responsible for any problems, viruses or technical malfunction of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, failure of email on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to a Participant’s or to any other person’s computer related to or resulting from participating or downloading materials for the Promotion.  

None of the Released Parties assume any liability for any personal injury or property damage or losses of any kind, including without limitation, direct, indirect, consequential, incidental, or punitive damages which may be sustained to a participant or any other person’s computer equipment resulting from a participant’s attempt to either participate in the Promotion or download any information in connection with participating in the Promotion or use of any website. Without limiting the foregoing, everything related to this Promotion and corresponding Prize is provided on an “as is” without any warranty of any kind, either express or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose or non-infringement.  

PointsBet Canada shall not be held responsible for any changes that may occur to the Prize. This includes, but is not limited to, any potential delays in transportation or other circumstances arranged by the winner, which prevent the winner or guest from attending the event, alterations to the event’s schedule (including cancellation) or any other unforeseen circumstances that could impact the overall experience related to the Prize. We advise all participants to consider the possibility of these factors and understand that PointsBet Canada will not be liable for any resultant inconveniences and will not be obligated to exchange, replace the Prize or fund any additional expenses in the event of such occurrences.  

17. Force Majeure

The Released Parties shall not be liable to any participant or any other person for failure to supply the Prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s), or request(s) by any governmental or quasi-governmental entity or gaming regulatory body (whether or not the action(s), regulation(s), order(s), or request(s) prove(s) to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, epidemic, pandemic, public health emergency, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption or any kind, work slow-down, civil disturbance, insurrection, riot or any other cause beyond the Released Parties’ sole control (“Force Majeure Event”). A Force Majeure Event expressly includes (i) an outbreak or resurgence of COVID-19 (as defined by the World Health Organization, which together with any related strains, variants, and mutations thereof and other similar infectious diseases, are collectively referred to herein as “COVID-19”), or (ii) action, order, regulation, or guidance taken or issued by a government authority in response to an actual or threatened outbreak or resurgence of COVID-19.

18. Governing Law

The Promotion shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Without limiting the generality of the foregoing, all issues and questions concerning the construction, validity, interpretation and enforceability of these terms and conditions or the rights and obligations as between any person and/or participant and PointsBet Canada in connection with the Promotion shall be governed by and construed and interpreted in accordance with the laws of the Province of Ontario.
