GENERAL: In these Official Contest Rules (“Official Rules”), “You” or “Your” or “Entrant” means the person who has entered this Contest (“Contest”). By entering this Contest, You agree to be bound by the terms and conditions contained in these Official Rules. This Contest is governed by Canadian law and is subject to all applicable federal, provincial, and local laws and regulations.

CONTEST ENTRY PERIOD: This Contest will be offered at the time of posting until the ending of the mentioned sports game of the day unless otherwise noted in the post (the “Entry Period”). Sponsor reserves the right to extend or shorten the Entry Period at its sole discretion. Sponsor’s clock shall be the official clock of this Contest.
ELIGIBILITY: This Contest is sponsored and administered by Sponsor. This Contest is only open to persons who: (1) are legal residents of Canada; (2) are nineteen (19) years of age or older at the time of entry; (3) have an eligible PointsBet Canada Sportsbook account on https://pointsbet.ca/ (i.e., the Entrant must not be on any provincial self-exclusion or involuntarily excluded list) prior to the close of the Entry Period; (4) have a valid, public (i.e., not protected) Instagram account; (5) at all times abide by these Official Rules; and (6) satisfy all requirements contained herein. Void where prohibited or restricted by law. Individuals on any involuntary provincial gambling exclusion list, provincial gambling self-exclusion list, and/or self-exclusion list for any PointsBet subsidiary are ineligible to participate in this Contest. Employees, their immediate families, and household members (whether related or not) of Sponsor or Sponsor’s affiliates, subsidiaries, or divisions (collectively with Sponsor, the “Sponsor Parties”) are not eligible to enter this Contest. HOW TO ENTER: Each day (or at Sponsor’s discretion) of the Contest, Sponsor will post a trivia question on its Instagram account @POINTSBETCANADA (a “Question”). To enter this Contest, You must: (i) follow @PointsBetCanada on Instagram; and (ii) comment on Sponsor’s Instagram post with the correct answer to the Question. Your comment with Your answer to the Question must remain publicly posted throughout the Entry Period. Submissions that are hidden or removed prior to the end of the Entry Period will be void. By successfully completing and submitting all required information as directed, You will be entered in this Contest and will receive one entry (an “Entry”). Your Entry must comply with: (i) the content restrictions (as set forth in the Content Restrictions section below); and (ii) the Instagram Terms of Use available at https://help.instagram.com/581066165581870. All information submitted online via Instagram is subject to, and will be treated in a manner consistent with, the Instagram Privacy Policy available at https://privacycenter.instagram.com/policy. If You do not have a Instagram account, visit Instagram.com or download the free Instagram application and register in accordance with the enrollment instructions to create an account. Data and usage fees may apply to the download and use of the Instagram application. Account registration must be completed within the Entry Period to qualify for the Contest.

PRIZE: One (1) prize will be awarded to one (1) winner each day the Contest is offered. The winner will receive one (1) gift card for merchandise of their choice. (“Prize”). Limit one (1) Prize per person, PER QUESTION.
The winner will be solely responsible for all costs and expenses associated with Prize acceptance and use not specified herein as being provided by Sponsor. The selection and awarding of the Prize will be conducted under the supervision of the Sponsor, whose decisions are final and binding in all matters pertaining to this Contest. Entrants agree to be bound by these Official Rules and the decisions of the Sponsor.
DETERMINATION OF WINNER: In the sole discretion of Sponsor, the winner will be randomly selected by Sponsor after the close of the Entry Period from among all eligible Entrants who have followed and comply with all eligibility rules. If an ineligible Entrant is randomly selected, that selection will be disregarded, and a new winner will be randomly selected. The winner who satisfies all eligibility requirements will be announced via post on the @PointsBetCanada Instagram page and notified directly via Instagram direct message (the “Notification”). The winner must reply to the Notification within seven (7) days of issuance to claim the Prize. Sponsor is not responsible for any changes to a winner’s information which may interfere with the winner receiving the Notification. In the event of a dispute concerning Entries submitted by multiple individuals using the same account, the Entry will be deemed to have been submitted by the authorized subscriber of the account used to enter this Contest. The winner may be required to submit his or her valid government-issued identification to Sponsor and, unless prohibited by applicable law, may be required to execute, have notarized and/or return an Affidavit of Eligibility, Consent to Publicity, Liability Waiver, and/or federal and provincial tax release within seven (7) days of the date of issuance of the same. The potential winner may also be required to answer a time-limited mathematical skill-testing question without assistance, whether mechanical or otherwise, as a condition of acceptance of any prize. In the event that a winner fails to submit any identification required by Sponsor, fails to return the required documents within the specified time period, fails to comply with these Official Rules, fails to respond to the Notification within seven (7) days, fails to comply with all instructions in the Notification, or declines the Prize for any reason, a disqualification will result, the Prize will be forfeited, and, at Sponsor’s sole discretion and time permitting, an alternate winner may be selected from among the remaining eligible Entries.
PRIZE TERMS: All Prize details shall be determined in the sole and absolute discretion of Sponsor. The odds of winning a Prize will depend on the number of Entries Sponsor has received by the end of the Entry Period and will decrease as more Entries are received. Sponsor will strive to deliver the Prize in a reasonable amount of time after all details have been sorted. The winner is solely responsible for any applicable federal, provincial, and local taxes (including income and withholding taxes) and any duties on the Prize. All Prizes are non-transferable and non-assignable, except in Sponsor’s sole discretion. No cash redemption of a Prize is permitted, except in Sponsor’s sole discretion. If a Prize is unavailable, Sponsor reserves the sole right to substitute a prize of equal or greater value. Redemption of a Prize is subject to all standard terms, conditions, and restrictions applicable to the Prize on the day of issuance.
CONDITIONS OF ENTRY: An eligible Entrant must enter by completing the entry procedures as described in these Official Rules. All Entries submitted that are not in compliance with these Official Rules are void. Incomplete Entries are void, including any inappropriate, incomplete, or duplicative Entries. Neither Sponsor, nor any of the Sponsor Parties, assumes any responsibility for late, lost, illegible, misdirected, or postage-due Entries. All Entries become the property of Sponsor and may not be returned or acknowledged. If any of the information You provide is inaccurate, You may be excluded from this Contest. Sponsor reserves the right to reject any Entry deemed untruthful in its sole discretion. By entering, Entrants accept and agree to these Official Rules, including all eligibility requirements. Proof of submission will not be deemed to be proof of receipt by Sponsor. By submitting any information or content to Sponsor, You represent that You have the full legal right to provide such information, and that use of the information by the Sponsor Parties will not: (a) infringe any intellectual property rights of any person or entity, or any rights of publicity, personality, or privacy of any person or entity; (b) violate any law, statute, ordinance, or regulation; or (c) constitute disclosure of any confidential information owned by any third party.
RELEASE: By participating in this Contest and submitting an Entry, You hereby certify that You have complied with all Contest rules and that You have committed no fraud or deception in entering this Contest or in claiming any Prize. The winner assumes all liability for any injury or damage caused, or claimed to be caused, by participation in this Contest. By entering this Contest, You give Your express permission to be contacted by the Sponsor Parties by telephone, email, social media message, and/or postal mail for Contest purposes. Each Entrant grants the Sponsor Parties a perpetual license to print, publish, broadcast, and use universe-wide, in any media now known or later developed at any time, Your name, portrait, picture, voice, likeness, and biographical information for any purpose, including for advertising and promotional purposes, without additional consideration or review by You, except where prohibited by law.
BY PARTICIPATING IN THis CONTEST, SUBMITTING AN ENTRY, OR ACCEPTING ANY PRIZE, EACH ENTRANT AGREES TO BE BOUND BY THESE OFFICIAL RULES, INCLUDING ALL ENTRY REQUIREMENTS, AND AGREES TO WAIVE ANY AND ALL CLAIMS AGAINST SPONSOR, THE SPONSOR PARTIES, Instagram INC., ALL OTHERS ASSOCIATED WITH THE DEVELOPMENT AND EXECUTION OF THis CONTEST, AND EACH OF the foregoing’s RESPECTIVE PARENT COMPANIES, AFFILIATES, SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AND AGENTS, (COLLECTIVELY, THE “RELEASED PARTIES”) FOR ANY LIABILITY FOR ANY INJURY, LOSS, OR DAMAGE OF ANY KIND, INCLUDING PROPERTY, PERSONAL INJURY, OR DEATH, DUE IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THE RECEIPT, ACCEPTANCE, POSSESSION, USE, OR MISUSE OF THE PRIZE (OR ANY PORTION THEREOF) OR PARTICIPATION IN THIS CONTEST OR ANY PRIZE-RELATED ACTIVITY. THE RELEASED PARTIES DISCLAIM ALL WARRANTIES, AND THE SELECTED PRIZE WINNER WAIVES ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE RELEASED PARTIES SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES OF ANY KIND WHATSOEVER, INCLUDING LOST REVENUES OR LOST PROFITS, WHICH MAY OR DOES RESULT FROM THE RECEIPT, ACCEPTANCE, POSSESSION, USE, OR MISUSE OF ANY PRIZE (OR ANY PORTION THEREOF) OR PARTICIPATION IN THIS CONTEST OR ANY PRIZE-RELATED ACTIVITY, REGARDLESS OF LEGAL THEORY, EVEN IF THE REMEDIES OTHERWISE AVAILABLE FAIL OF THEIR ESSENTIAL PURPOSE. UNDER NO CIRCUMSTANCES WILL THE TOTAL LIABILITY OF THE RELEASED PARTIES IN CONNECTION WITH, BASED UPON, OR ARISING FROM THE RECEIPT, ACCEPTANCE, POSSESSION, USE, OR MISUSE OF THE PRIZE (OR ANY PORTION THEREOF) OR PARTICIPATION IN THIS CONTEST OR ANY PRIZE-RELATED ACTIVITY, EXCEED THE AMOUNT OF THE PRIZE.
CONTENT RESTRICTIONS: Entrants must not include any of the following content (collectively, the “Content Restrictions”) in any Entry: (a) pornography, adult-oriented content or any other sexually-explicit material; (b) explicit language or content, images of violence, or promotion of illegal activities; (c) content in violation of intellectual property rights or laws; (d) libelous, defamatory, disparaging, tortious or slanderous materials; (e) content that denigrates, disparages or reflects negatively on the Sponsor or Sponsor Parties, or their respective officers, directors, employees or agents; (f) tobacco, e-cigarettes, alcohol or drugs; (g) dangerous stunts; (h) real weapons of any kind including, but not limited to, guns, knives or projectiles; (i) material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, age or any other basis protected by federal, state, territory, provincial or local law, ordinance or regulation; (j) individuals under legal age of majority; (k) audio and/or visual content owned by any third party (e.g., recorded music, pre-produced video, etc.); and (l) material that is unlawful, or otherwise in violation of or contrary to the laws or regulations in any state, territory or province where the Entry is created. Any Entry that does not comply with the foregoing, in the sole discretion of Sponsor, will be disqualified.
MISCELLANEOUS: The Sponsor Parties are not responsible or liable for any events beyond their control which may cause this Contest to be stopped, including any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, Entries, nor are they responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any email or Entry to be received by Sponsor on account of technical problems, human error, filtering or traffic congestion on the internet or at any web site, insufficient space in an Entrant’s account to receive messages or any combination thereof, including any injury or damage to Entrant’s or any other person’s computer relating to or resulting from participation in this giveaway or downloading any materials in this Contest. If, for any reason, this Contest is not capable of being conducted as planned, including due to tampering, unauthorized intervention, typographical errors, technical failures, fraud, low participation, or any other causes beyond the reasonable control of the Sponsor Parties that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsor reserves the right at its sole discretion to cancel, terminate, modify, or suspend this Contest at any time. Sponsor reserves the right in its sole discretion to disqualify any individual found to be tampering with the entry process or the operation of this Contest or to be acting in violation of these Official Rules or any other promotion, or in an unsportsmanlike or disruptive manner. When used herein, the words “includes” and “including” and their syntactical variations shall be deemed followed by the words “without limitation.” ANY ACT OR ATTEMPT TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THis CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ACT OR ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ACT OR ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
CHOICE OF LAW AND JURISDICTION: All applicable federal, provincial and local laws and regulations apply. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of an Entrant and Sponsor in connection with the Prize, shall be governed by, and construed in accordance with, the laws of the Province of Ontario without giving effect to any choice of law or conflict of law rules (whether of the Province of Ontario or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Province of Ontario. All suits or claims brought in connection with this Contest must be brought in a provincial or federal court located in the City of Toronto, Ontario, and all Entrants irrevocably consent to the jurisdiction and venue of such courts. If any provision of these Official Rules is declared invalid or unenforceable, such provision will be deemed modified to the extent necessary and possible to render it valid and enforceable. The unenforceability or invalidity of any provision will not affect the validity and enforceability of any other provision of these Official Rules, and these Official Rules will continue in full force and effect and be construed and enforced as if such provision had not been included, or had been modified as described above, as the case may be.
You agree that any and all disputes that cannot be resolved between the parties, and any and all causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration in a location selected solely by Sponsor.
PRIVACY POLICY: Any personally identifiable information collected during an Entrant’s participation in this Contest will be collected by Sponsor and used by Sponsor: (i) for purposes of proper administration and fulfillment of this Contest as described in these Official Rules; and (ii) as described in Sponsor’s privacy policy, posted on Sponsor’s website. In addition, each Entrant agrees that Sponsor may share any personally identifiable information supplied as part of the entry process with any of the Sponsor Parties and any and all other companies associated with this Contest, the use of which will be governed by the privacy policy maintained by such Sponsor Parties or associated company.
WINNERS LIST: For the name of the winner of this Contest, mail a self-addressed stamped envelope with the name of this Contest to Sponsor at Sponsor’s address set forth in these Official Rules, Attn: “Winners List – PointsBet Trivia Contest” and include the date of the particular contest you are inquiring about. All requests must be received no later than thirty (30) days after the close of the Entry Period.

CHOICE OF LAW AND JURISDICTION: All applicable federal, provincial and local laws and regulations apply. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of an Entrant and Sponsor in connection with the Prize, shall be governed by, and construed in accordance with, the laws of the Province of Ontario without giving effect to any choice of law or conflict of law rules (whether of the Province of Ontario or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Province of Ontario. All suits or claims brought in connection with this Contest must be brought in a provincial or federal court located in the City of Toronto, Ontario, and all Entrants irrevocably consent to the jurisdiction and venue of such courts. When used herein, the words “includes” and “including” and their syntactical variations shall be deemed followed by the words “without limitation.” ANY ACT OR ATTEMPT TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ACT OR ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ACT OR ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
CHOICE OF LAW AND JURISDICTION: All applicable federal, provincial and local laws and regulations apply. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of an Entrant and Sponsor in connection with the Prize, shall be governed by, and construed in accordance with, the laws of the Province of Ontario without giving effect to any choice of law or conflict of law rules (whether of the Province of Ontario or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Province of Ontario. All suits or claims brought in connection with this Contest must be brought in a provincial or federal court located in the City of Toronto, Ontario, and all Entrants irrevocably consent to the jurisdiction and venue of such courts. If any provision of these Official Rules is declared invalid or unenforceable, such provision will be deemed modified to the extent necessary and possible to render it valid and enforceable. The unenforceability or invalidity of any provision will not affect the validity and enforceability of any other provision of these Official Rules, and these Official Rules will continue in full force and effect and be construed and enforced as if such provision had not been included, or had been modified as described above, as the case may be.
YOU AGREE THAT ANY AND ALL DISPUTES THAT CANNOT BE RESOLVED BETWEEN THE PARTIES, AND ANY AND ALL CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS CONTEST, SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION, AND EXCLUSIVELY BY ARBITRATION IN A LOCATION SELECTED SOLELY BY SPONSOR.
PRIVACY POLICY: Any personally identifiable information collected during an Entrant’s participation in this Contest will be collected by Sponsor and used by Sponsor: (i) for purposes of proper administration and fulfillment of this Contest as described in these Official Rules; and (ii) as described in Sponsor’s privacy policy, posted on Sponsor’s website. In addition, each Entrant agrees that Sponsor may share any personally identifiable information supplied as part of the entry process with any of the Sponsor Parties and any and all other companies associated with this Contest, the use of which will be governed by the privacy policy maintained by such Sponsor Parties or associated company.
WINNERS LIST: For the name of the winner of this Contest, mail a self-addressed stamped envelope with the name of this Contest to Sponsor at Sponsor’s address set forth in these Official Rules, Attn: “Winners List – PointsBet Trivia Contest” and include the date of the particular contest you are inquiring about. All requests must be received no later than thirty (30) days after the close of the Entry Period.
